Puisqu’il avait transgressé les règles du Mauritius Turf Club le 10 juillet
2008, le jockey, accusé de tricherie, avait été suspendu pendant huit mois et
devait aussi payer une amende de Rs 50 000. Après une analyse du dossier, la
magistrate a conclu que Nishal Teeha ne peut être poursuivi à deux reprises
sous la même charge.
Dans son ruling, la magistrate écrit : “I do not agree with the submission of
Learned Prosecuting Counsel. The law about double jeopardy deals with the same
act and the same offence, may the charge levelled against the Accused concerns
different enactments. The offence alleged against the Accused in this case is
the very act for which he has been sanctioned by the Mauritius Turf Club. The
acts for which the Accused has been sanctioned and for which he stands charged
are the same and the offences are the same. Hence, I find that given that the
Accused has already been punished by the regulatory body empowered so to do
cannot be punished twice for the same offence”.
